This Privacy Notice (“Notice”) explains how EchoReach, LLC (“EchoReach,” “we,” “us,” or “our”) collects, uses, shares, stores, and retains personal information when you visit our website (the “Site”) or interact with us by phone, SMS, email, or web forms, and describes your rights and choices. 1. Personal Information We Process
Categories we may collect:
Identifiers & contact details: name, company, job role, email address, phone number.
Communications & submissions: the contents of messages you send to us by form, SMS, or voicemail; scheduling preferences.
Telephony metadata: call/SMS time, duration, from/to numbers, texts sent/recieved, delivery status (not the content of calls unless you leave a voicemail).
Sources: directly from you; automatically from your device; and from our service providers (e.g., telephony delivery status from Twilio).
We do not intend to collect Sensitive Personal Information (e.g., government ID numbers, precise geolocation, health/biometric data) or information about children. Please do not submit such data.
2. How We Use Personal Information (Purposes & Legal Bases)
We use personal information to:
Respond to inquiries and provide services, including capturing missed calls, collecting lead details, and coordinating call-backs.
Operate and secure the Site and our communications systems; prevent fraud and abuse.
Maintain business records, analytics, and service improvement.
Send service-related communications (e.g., confirmations, follow-ups).
Comply with laws, enforce our Terms of Service, and protect rights.
Legal bases (for EEA/UK visitors): consent (e.g., marketing SMS where applicable), performance of a contract or pre-contract steps (responding to your request), legitimate interests (site operation, security, service improvement), and legal obligations.
3. How We Share Personal Information
We do not sell personal information and do not share it for cross-context behavioral advertising as those terms are defined by U.S. state privacy laws.
We may disclose personal information to:
Service providers/sub-processors that help us operate the Site and communications (hosting, telephony/SMS, CRM, automation, email). These providers may access personal information only to perform services for us and under contract.
Professional advisors (lawyers, auditors) under confidentiality.
Authorities when required by law or to protect rights, safety, or the integrity of our services.
Business transfers: if we undergo a merger, acquisition, financing, or sale of assets, information may be transferred as permitted by law.
Current sub-processors (subject to change): Squarespace (site hosting), Twilio (voice/SMS), Airtable (CRM), Voiceflow (automation), Google (email/workspace). We will update this list as our providers change.
4. International Transfers
We operate in the United States. If you access the Site from outside the U.S., your information may be processed in the U.S. and other countries with different data-protection laws. Where required, we use appropriate safeguards (e.g., data-processing agreements and standard contractual clauses).
5. Retention
We keep personal information only as long as necessary for the purposes described above (for example, to respond to inquiries, maintain records, comply with legal obligations, or resolve disputes). When no longer needed, we delete or de-identify information in accordance with our retention practices and applicable law.
6. Security
We apply reasonable technical and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. No system is 100% secure.
7. Your Choices & Rights
Communications:
SMS/Text: reply STOP to opt out of non-essential texts; reply HELP for help.
Email: use the unsubscribe link where available or contact us.
Privacy rights (depending on where you live): You may have the right to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing. U.S. state residents (e.g., CA, CO, CT, UT, VA) may have additional rights, including the right to appeal a decision. We will not discriminate against you for exercising your rights.
How to exercise: email us at jackmgans@gmail.com with the subject “Privacy Request.” We may need to verify your identity. You may also authorize an agent where permitted by law.
8. Children
Our Site and services are not directed to children under 13 (or under the age required by local law). We do not knowingly collect children’s personal information. If you believe we have done so inadvertently, contact us and we will delete it.
9. Third-Party Links and Sites
Our Site may link to third-party websites or services. Their privacy practices are governed by their own policies.

We may update this Notice from time to time. The “Last updated” date indicates the latest version. Material changes will be posted on this page.

U.S. State Privacy Disclosures (California/Colorado/Connecticut/Utah/Virginia)
Categories collected: identifiers (name, email, phone), commercial inquiry data (messages, scheduling preferences), internet or network activity (device/usage), and in limited cases inferences for service improvement (non-profiling).
Sources: you; your device; service providers.
Purposes: as listed in Section 2.
Disclosures for business purposes: to service providers listed in Section 3.
Sales/Sharing: We do not sell personal information and do not share it for cross-context behavioral advertising.
Retention: as in Section 5.
Rights & appeals: as in Section 7. You may submit requests at jackmgans@gmail.com. If we deny your request, you may appeal by replying to our decision email with “Privacy Appeal.”
TCPA Consent (for U.S. calls/texts)
By submitting your contact information on our Site or communicating with us, you consent to receive communications from EchoReach via phone, SMS, and email about your inquiry. Message/data rates may apply. Reply STOP to opt out at any time. Consent is not a condition of purchase.

EchoReach Terms of Service (Month-to-Month)
Service. EchoReach provides an SMS agent that replies to missed calls, captures contact details, and sends lead notifications to the business. EchoReach is not for healthcare/PHI.
Subscription & Billing. $129 per month, billed in advance each month until canceled. Charges are processed by Stripe.
Cancellation. Cancel anytime in the Customer Portal; service remains active through the current paid period. No refunds for partial periods.
Fair Use. Plan includes up to 1,500 SMS segments/month (inbound + outbound combined). Sustained usage above this level for two consecutive months may be upgraded to a higher-volume plan or billed at $0.02 per additional segment starting the next cycle.
Compliance. Customer represents that its use complies with TCPA/CTIA; opt-out keywords (STOP/UNSUBSCRIBE) and HELP are honored. Toll-Free Verification is required before high-volume messaging.
Data. We store lead contact details and message metadata for service delivery and diagnostics. See our Privacy Policy for details.
Availability. EchoReach aims for high availability but may be impacted by carrier/Twilio outages or customer configurations.
Limitation of Liability. To the maximum extent permitted by law, EchoReach’s aggregate liability is limited to fees paid in the three (3) months prior to the event giving rise to the claim.
